Terms of Use

Last updated: October 2026 · Version v4.6-2026

1. About HostMasters

HostMasters, trade name of Yuri Rodolfo Alves Sales de Almeida (sole trader, NIF Z3680371P), Almuñécar, Granada, España (“HostMasters”) manages short-term rental properties on the Costa Tropical, Spain, on behalf of their owners: it runs the Airbnb and Booking.com listings as co-host, sets nightly prices within limits agreed with the owner, looks after guests (including emergencies) and coordinates cleaning, through its own local team and platform.

2. Account Registration

3. Platform Roles

Users are assigned one of these roles, each with distinct rights and obligations:

4. Plans & Payments

All HostMasters prices are net, “+ IVA”: Spanish VAT (IVA, 21%) is added on top of each invoice, and the amount you pay or have deducted is the invoice total including IVA. The commission is a percentage of the payout actually received from the booking channel (Airbnb, Booking.com…) for each stay, with IVA added on the commission. There is no monthly minimum commission. Rental income HostMasters collects on your behalf is your money, not a HostMasters sale, and carries no HostMasters IVA.

4.1 Collection mandate and monthly settlement

Unless agreed otherwise in writing, the owner instructs HostMasters to collect, in the owner's name and on the owner's behalf, the payouts of the booking channels (Airbnb, Booking.com and others) for the owner's properties. To do so, the owner points the channel's payout method to the bank account HostMasters keeps for client funds, separate from its own operating account, or the listing is held in HostMasters' channel account. Rental income belongs to the owner: it is collected on the owner's behalf and is not HostMasters' income.

4.2 Payment terms

When each party is paid, and how, is set out in our Payment Policy, which forms part of these Terms and of every agreement signed through the platform. In summary:

The agreements are signed in Spanish and English and the Spanish version prevails.

5. Property Requirements & Smart Lock

Property owners must ensure:

5.1 Smart Lock terms

6. Service Providers (Independent Autónomos)

Service providers operate as independent professionals (autónomos) and must be registered as self-employed in Spain (alta en el RETA and census registration, Modelo 036/037) before performing any task. HostMasters is not their employer and does not provide employment benefits, social security contributions, paid leave, or tax withholding. Each service provider invoices HostMasters and is solely responsible for declaring and paying their own taxes and Social Security contributions.

Service providers are free to accept or decline each task they are offered, without penalty. They set their own schedule, use their own tools and may work for other clients. There are no minimum hours, shifts or exclusivity.

Specific terms (rates, payment schedule and the handling of personal data seen during a task) are governed by the individual Service Provider Agreement signed at onboarding and by the Payment Policy.

7. Intellectual Property

The HostMasters platform, including its software, design, branding, and AI systems, is the intellectual property of HostMasters, trade name of Yuri Rodolfo Alves Sales de Almeida (sole trader, NIF Z3680371P), Almuñécar, Granada, España. Users may not copy, modify, or distribute any part of the platform without written permission.

8. Prohibited Conduct

9. Data Protection

Personal data is processed under the GDPR (EU 2016/679) and Spanish LOPD-GDD (LO 3/2018). The full data-protection framework — including processor roles, sub-processors, retention, security measures, and automated decision-making — is set out in our Privacy Policy, our Cookie Policy, and the Data Processing Agreement (DPA).

By using the platform, you accept those documents. They form part of these Terms by reference.

10. Limitation of Liability

To the maximum extent permitted by law, HostMasters is not liable for:

Total aggregate liability is capped at the fees paid by the Owner to HostMasters in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability for gross negligence, wilful misconduct, or death/personal injury caused by negligence — as required by Spanish law.

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, government action, pandemic, internet or utility outages affecting EU infrastructure, or failure of essential third-party providers (Stripe, Vercel, Neon, Resend, OTAs). The affected party shall notify the other within 7 days and use reasonable efforts to mitigate.

12. Termination

13. Dispute Resolution

Before initiating legal proceedings, the parties agree to attempt resolution in the following order:

  1. Good-faith negotiation — written notice of the dispute and a 30-day negotiation window between authorised representatives.
  2. Mediation — non-binding mediation under the rules of the Cámara de Comercio de Granada, if negotiation fails.
  3. Courts — the courts of Granada, Spain. Where the user is a consumer, this does not limit the consumer's right to bring or defend proceedings before the courts of their own domicile (art. 90.2 TRLGDCU; Regulation (EU) 1215/2012, art. 18).

Spanish consumer-protection law applies where the user is a consumer (not acting in a professional capacity). Consumers retain the right to file complaints with the appropriate regulator (e.g., Junta de Andalucía consumer office — official complaint forms are available on request at info@hostmasters.es —, AEPD for data matters).

Right of withdrawal (consumers). If you are a consumer and you sign an agreement with HostMasters at a distance (online), you may withdraw from it within 14 calendar days of signing, without giving any reason and at no cost, by writing to info@hostmasters.es (a model withdrawal form is available on request). If you asked us to start the service during those 14 days, you pay only for the services already provided up to your withdrawal, in proportion to the agreed price (arts. 102–108 TRLGDCU). One-off services fully performed at your express request before the end of that period can no longer be withdrawn from.

14. Governing Law

These Terms are governed by Spanish law and applicable EU regulations. The agreements signed through the platform (including the Master Service Agreement) are executed in Spanish and English, and both versions are signed together; in case of discrepancy between them, the Spanish version prevails. Agreements are not provided in any other language.

15. Changes to Terms

We may update these Terms. Material changes will be communicated via email and in-app notification at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
